HIS LORDSHIP SRI JUSTICE SURYA KANTH, SUPREME COURT OF INDIA

His Lordship Justice Surya Kant, Judge of Hon’ble Supreme Court of India, while addressing the inaugural session of Supreme Court Bar Association’s Lecture Series “Justice for all on Legal Aid and Mediation”, Commented, while, expressing disappointment with the functioning of some of the High Court Judges.

According to his Lordship, most of the High Court Judges are head strong in their commitment and carry heavy burdens as torch Barrers of Justice, but, performance of some of the High Court Judges is deeply disappointing.

His Lordship Justice Surya Kant, underlined, Paradoxical situation of rendering “JUSTICE” as a Cloister virtue. His Lordship expressed surprise for the delay of nearly three years in pronouncing verdict in reserved Criminal Appeals.

There is a Criticism against the functioning of some High Court Judges are being partial in politically sensitive Cases, either favouring the Ruling Parties or such Business Interests. It is pertinent, to note that, some of the High Court Judges are insensitive, in adhering to Articles 141 and 142 of Constitution of India, Exhibiting, open reluctance to comply with the Law laid down by the Hon’ble apex Court, Obviously, under misnomer, that they are also equal to the Judges of the Hon’ble Supreme Court of India.

The Judgements rendered by some of the High Court Judges are either infested with poor reasoning or without any reasoning. It is time to establish Judicial Performance Commission, to review the performance of High Court Judges, by inviting feed- back from Litigants, Advocates and Public.

In this context the call given by His Lordship Justice Surya Kant is worth remembering “To those whose dedication falls short, I have a simple request – before you rest your head on your pillow, each night, ask yourself one question: how much public money was spent on me today? Have I repaid society for the trust placed in me.”

There is a genuine feeling among people of this Country, that in the selection process of High Court Judges, though, thorough the “Collegium System”, those having the blessings of the Political Party in Power are only blessed with the posts, main criterion being the loyalty to the party in power, oblivious of, the Merit and Integrity of the Candidate. This type of flawed selections are showing telling effect on the efficacy and credibility and fairness of the India’s Judicial System.
